Zina (in arabic: الزنا, in ibrani: ניאוף – zannah) is sexual intercourse between those who have not yet been married.
In Islam the doer of zina is clasified into two, that is: muhshan (the doer that already married) and ghairu muhshan (the doer that never married)
Zina is one among big sins in islam. The practise of zina is strictly prohibited by Qoran as well as by hadith (what the prophet said).
Qoran al-Israa (17):32
“And never you come near unto adultery; surely, it is a foul thing and an evil way”
The ayat told that zina is a big sin by state that it is a foul and evil. What is the punishment to those who break the law of Islam by doing adultery? When the adulterer/adulteress are those who have never married, the Qoran say:
“The adulteress and the adulterer (or the fornicatress and the fornicator) — flog each one of them with a hundred stripes. And let not pity for the twain take hold of you in executing the judgment of Allah, if you believe in Allah and the Last Day. And let a party of the believers witness their punishment.”
While those who have or had ever been married, the prophet says that the stoning is the only way for them to repentence, if what they were doing is known by the judge, either through their confession or from the report 4 witnesses that they swear saw it by their eyes. But the prophet is prefer not to stoning them, if they keep the secret themselves and repentence afterward and promise themselves not to do the adultery anymore.
Narrataed by Muslim from Nu’aim bin Hazzal: Maiz had fornicate a slaver……then he come to the prophet and said: O prophet, I really had fornicate. Please punish me with the law of Islam. And the prophet turned from him. Then Maiz repeated what he said and the prophet turned from him again until 4 times they doing that. At the fourth confession the prophet said: you told it four times, now with whom did you do that? He answered with “her”. The prophet said: did you caressed her? He said: yes. Then then prophet asked: did you copulate her? He answered: yes.
Then the prophet ordered to stoning ………and when he feel the pain from the throwing stone, he cried and run…..and Abdullah ibn Unais throw him with the camel’s bone to the death and told to the prophet. The prophet said: why don’t you let him go, may be he would repent from his sin, and Allah receive his repentance (Narated by Muslim)
